GENERAL PROVISIONS
These terms of the GamiSell system (hereinafter - Rules ) constitute an agreement between MB RAIDAS , legal entity code 306456394 , registered office address Siluvos st. 1, 47119 Kaunas, Lithuania (hereinafter - the Company or we) and you, according to which we will give you the opportunity to use "GamiSell" - an effective motivational system, a business-oriented system that allows you to enrich the results of employees' daily work with a game (hereinafter - the GamiSell system), which accessible via the https://www.gamisell.com website (hereinafter - the Website).

The GamiSell system is for B2B use only, it is not intended for consumer use and you may use it for purposes related to your business or profession. Therefore, the requirements of legal acts protecting consumer rights will not apply to you.
You have the right to use GamiSell only if you can enter into a binding contract with us under applicable law, and only if you comply with these Terms and applicable laws. By registering on the Website, you confirm that you are acting for purposes related to your business or profession and, if you are registering on behalf of a legal entity, that you have the right to represent such a legal entity.
REGISTRATION AND USE OF THE GAMISELL SYSTEM
In order to use the GamiSell system, you must register on the Site and add at least three team members.
You must complete the requested data in the registration and member registration forms. Make sure that the data provided is correct. We process the data you provide for the purposes and procedures provided for in the Privacy Policy. Before providing personal data of team members (other persons), you must ensure that you have a valid legal basis for doing so. You are responsible for informing team members that you will be providing their data to us and, if necessary, obtaining their consent.
After forming a team, you must select a GamiSell game ( the Game(s) ) and set the objectives of the Game.
Each Game takes place according to the Game Description. Depending on the situation, the Game content and management is available through your account on the Website and/or sent to the Game participants by e-mail.
PRICE AND PAYMENT
Newly registered users of the GamiSell system are offered the opportunity to try the GamiSell system for free for 7 days. During the free trial, you can use all the functions of the Free plan of the GamiSell system.
We offer various subscription plans and prices for the GamiSell system. Detailed information about each plan can be found on the Website. We reserve the right to update or change subscription plans and prices by posting on the Site.
You can pay on the website in the following ways: electronic banking, credit card, bank transfer.
When ordering a subscription to the GamiSell system, periodic payments are made. The rules for recurring payments form an integral part of these Rules - please read them before confirming a payment.
After you confirm the Game order, we receive all the information about it. The game order is considered submitted from the moment it is received by the Company. At the same time, in such a case, it is considered that a contract has been concluded between you and the Company. However, the Company must execute such an agreement only from the moment the Company receives the payment service provider's confirmation of payment for the ordered Game (the first period when the GamiSell system subscription is selected).
GAME FEATURES AND QUALITY
The features of the games are indicated on the Website next to the description of each Game. The Company undertakes to provide a Game that corresponds to the information specified in the Game description provided on the Website.
Games may be provided using services provided by third parties. The Company will take all actions within its power to ensure that the services provided by third parties are provided properly and do not interfere with the presentation of the Games, but the Company is not responsible for the actions or omissions of such third parties. If the Game cannot be presented in good quality due to reasons dependent on third parties, the Company will offer measures to correct the deficiencies.
USE OF GAME CONTENT
By ordering the Game, you acquire the right (license) to use the Game content under the following key conditions, which you undertake to comply with:
• Use the game and its content for professional purposes only.
• The Game and its content can only be used by you and your legally invited team members, and you have no right to copy, transfer (for a fee or free of charge) the content of the Game (or any part thereof) or grant other rights to other persons to use it (or any part) (for a fee or free ).
• You may not modify, alter, translate, remake, or create derivative works of the Game or its content.
• The rights granted to you are non-exclusive, that is, the Game can be used both by the Company itself and by other persons.
• You may use the Game and its content for as long as specified in the Game Description.
If you do not use the Game within the specified period, the contract concluded between the Company and you is deemed to have been properly fulfilled, unless otherwise agreed with the Company.
INTELLECTUAL PROPERTY
By using the Site and the GamiSell system, You understand and acknowledge that: (a) all intellectual property rights in the GamiSell system, Games, Site and individual parts thereof; (b) any trademarks or other marks used to designate the GamiSell system, the Games or the Site; (c) all trademarks and logos, domain names used in the GamiSell System, Games and Website; (d) all individual elements thereof, including texts, photographs, drawings and all materials, (e) the presentation, appearance and design of any page of the GamiSell System, Game or Website and (f) all intellectual property rights therein belong exclusively to the Company and /or to other persons. You undertake not to copy, modify or otherwise use these intellectual property objects without the separate written consent of the Company or other rights holder.
RESPONSIBILITY
The company's responsibility for the quality of the Games is determined by the applicable legal acts.
You must provide the Company with all correct and complete information requested and comply with the requirements of these Rules.
You are responsible for the security of your username, password or other data that allows you to connect to the Website, use the GamiSell system and the Games. However, if you notice that someone is using your username and password in an unauthorized manner, please contact us immediately.
AMENDMENTS AND TERMINATION
The Company may change these Rules from time to time. The latest (current) version of the Rules will always be visible and available on the Website. Before registering on the Website, you must familiarize yourself with the current version of the Rules.
The Company will have the right to discontinue (terminate) the operation of the GamiSell system and/or the Website at any time.
OTHER TERMS
These Rules are drawn up and must be interpreted in accordance with the laws of the Republic of Lithuania.
Any disputes, disagreements or claims arising from or related to these Rules, as well as issues of their violation, termination or validity, shall be resolved in the courts of the Republic of Lithuania in accordance with the procedure established by the laws of the Republic of Lithuania.
All warnings or other notices related to these Rules will be provided by email. by mail (when sending to us - to the e-mail address specified at the beginning of the Rules, when sending to you - to the e-mail address provided in your account).
If any of the provisions of these Rules is or becomes invalid in whole or in part, the validity of the remaining provisions shall not be affected.
